| anyone know how close i can build a shed to my neighbors fence?the very nice chap at the back of are garden seems to think it's two close 40cm!if i have to move it it'l be a days work!!he has already phoned his solicitor as he told me that when his house was built over 14 years ago he fence was set back 50cm!my loft is 40cm 10 cm on his land? goldenl |

goldenl i had loads of problems at old house ended up banging the neighbour (well he did invite me over to sort it man to man) the loft had to be 1 metre from boundary. it took me 6 months to get permission for my big loft and had to cut a stunning loft into 2 sections to avoid planning permission. moved since and have a bit more free reign. |

| Golden any new building temporaryu or otherwise must be at least 1 metre from a boundry fence, wooden buildings are classed as temporary. sorry mate just tell him you will shift it asap |

| I had a similar problem, I did however tell the nice gentleman who lives next door if I have to get rid of the birds I am going to buy a nice loud motorcycle and join the Hells Angels, that is after I have banged him. I did have a visit from a nice lady from the council who said everything is how it should be. If you have had this extra land for over three years then technically he can do sod all about it or you demand to see his deeds that will show the full extent of his property, then demand he moves his fence to the dge of his boundary. |

does that apply to concrete bases as well dont mind moving the shed but to dig up the concrete golden |

goldenl hi golden, why was the fence set back 50 cm? has he any proof ie measurements on his house plans ? they need checking before you do anything ...... also if this is true that the fence was built 50 cm short of his property this means that the 50cm has been automatically claimed by you or the previous owner of your house because you have maintained the strip of land for 14 years, he made it quite clear he didnt want the land. also, another thing i would do if it was me, if it does come about that you have to move your loft, demand that he also moves the fance 50cm outwards which will mean he too has a lot of work to do, fight fire with fire i say........ |

| the moving of the fence may be your bargaining tool, because you can say, OK, I move my shed which is gonna take me a day and £0. But Insist you move your fence which will cost near on a grand. So lets be civilised about this and leave things as they are. Otherwise this is going to become tedious and costly. |

| I cant get the hole fence in the picture but it runs all the way across the back of our garden there is properly another 15 foot to the left of the picture. thanks for all the advice. golden |

| look into his measurements and plans golden, also check your own plans........and as we say hes not going to be happy moving that fence to where he claims it should be, so use it as a bargening point. |

Spot on Gaz but if the fence has been there for over 12 years (and from what Golden has said the fence was set back 14 years ago) looked after the land than if you take a look at a law book technically that land belongs to Goldern But you are correct Gaz with telling him to move his fence to the original boundary line which is more costly to him |

| Wow that is some back garden mate, I dont think you will have any trouble at all mate. Its neat tidy and no way an eye sore. Maybe it may cost the guy more to move his fence as maybe there could be trees in the way. Just tell him to SFU, join the RPRA pronto, they will back you as being a member. Best of luck mate. |
